Keith New, a spokesman for the servicer, the Pennsylvania Higher Education Assistance Agency (known to borrowers as American Education Services), said, “We believe that the auditors were misinformed about the scope of P.H.E.A.A.’s contractual obligations. We are confident that the litigation will reveal that the agency has acted properly and in accordance with its agreements.”
I have an SBA loan which has been mishandled by the bank. Briefly, my originating bank was absorbed by another. The first bank applied each payment correctly (fixed principle, WSJ interest + 2%) and not a single payment was missed in 7 years. When the new bank took over, they misapplied every payment (keeping up to 75% in interest and not reducing the principle) until I eventually stopped paying. They denied receiving certified mail, they denied ever having heard from me, they would not discuss the problem. I now pay Treasury directly but have incurred a penalty. And I have overpaid 2K to the bank. And they are holding my life insurance hostage (with an assignment to the original bank) and refuse to put in writing that the loan has reverted to Treasury. I am looking to sue for the overpayment and for damages because I’ve been put in an untenable position. I have paperwork to back up everything but limited funds for an attorney. What can I do? The gov’t says I’m on my own. Thanks for any assistance in advance.
In addition to your credit score, lenders will consider how long your business has been operating. You need to have been in business at least one year to qualify for most online small-business loans and at least two years to qualify for most bank loans.
The 7(a) Loan Guarantee Program is designed to help entrepreneurs start or expand their small businesses. Interest rates on SBA 7(a) loans currently range from 6.75% – 9.25%. The interest rate depends on a variety of factors, such as your credit score and the length of the repayment term. I received a disaster loan after hurricane Katrina. I had a small house that I was remodeling. My insurance cancelled because house was not livable. I became disabled after getting the loan and was forced to file for SS disability. With the decline in my income I missed a couple of payments and my loan was turned over to a collection agency. They deduct my payment out of my SS check before I get it. It doesn’t leave me enough to even rent an apt. Is there any way I can get this loan forgiven. Please help!

It’s also a good idea to ask your lender about any potential penalties or discounts that may apply to your loan. For example, some lenders discourage prepayments by enforcing penalties while others offer you a discount for paying off your loan early.
There are two loan approvals you’ll need to obtain. First, your bank must review your application and decide whether you meet their qualifications for funding, subject to SBA approval. Banks are obligated to observe the “credit elsewhere” rule, meaning that if your company is qualified for a loan from any other source without the credit insurance provided by SBA, you should be sent there.
In addition to the above, if you are using the loan to buy commercial real estate it must be at least 51% owner occupied. For example, you cannot use a 504 loan to purchase a hotel that you will fully rent out to tenants. But you can use a 504 loan to purchase retail space that you will use most of and rent out a small part of to another tenant. New construction has even higher owner occupancy requirements. To view a comprehensive list of CDC / SBA 504 eligibility requirements, visit the SBA’s website.

It’s possible your partner’s credit might carry the day for you, but that will depend on the bank, the underwriter, etc. Any ding on your credit will show up. You need to demonstrate to the bank you and your partner are a good credit risk. Startup funding is tough, even on its best days. Good luck.
The most popular SBA loan program is the 7(a) loan, designed to provide funds for a broad list of businesses. These loans target “small” companies, defined according to the North American Industrial Classification System (NAICS), which determines whether a company is small by its annual revenues or number of employees.
Ever since Congress created the SBA in 1953, this federal agency has helped guarantee millions of loans to small and mid-sized businesses, in addition to providing counseling, contracts, and other forms of assistance. The idea behind the SBA-backed loans was that the commercial banking system wasn’t offering small business owners the same types of access to capital to start, grow, and keep their businesses functioning that those financial services institutions offer to larger businesses — given that they often have more assets and collateral, a larger cash flow, and a lengthier and more proven credit history.

But National Collegiate’s problems are especially acute, she said. Over and over, she said, the company drops lawsuits — often on the eve of a trial or deposition — when borrowers contest them. “I question whether they actually possess the documents necessary to show that they own loans,” Ms. Smith said.
When we talk about an SBA 504 loan, we’re really talking about two different loans. One loan for 50% or less of your deal is issued by a traditional lender like a bank, credit union, or non-bank lender. The other loan is issued by a CDC for 40% or less of your deal. The difference of at least 10% is made up by you, the borrower. The two loans will have different rates, terms, fees, and limits. Combined, these rates will make up your total SBA/CDC 504 loan rates. We’ll discuss both below.

These loans are an option if you need a smaller sum of money to get your business started or to expand it, but don’t need the larger sums of a 7(a). For example if you need to buy a new oven for your bakery — a micro loan could be a good fit.
