You can’t have a business that lost money and expect the SBA or anybody else to guarantee that loan. It wouldn’t make sense.”

Hi, I live in California and defaulted on an SBA loan in 2003 when my business closed. I continued making sparatic payments through 2008 and could no longer make payments and had no other contact with SBA until 2013. My final response to SBA was the Statue of Limitations was passed on collecting on the loan, which in California is 4 years. Recently, my Federal tax return. What can be done at this point?
Don’t be a fad-follower: Did you start your company because you are truly passionate about your idea or because you want to cash in on the latest trend? Angels can spot the difference and won’t give much attention to those whose companies are essentially get-rich-quick schemes.
It is important to consider existing debt, whether it be from credit cards or previous loans. If you aren’t planning on using your funds for debt consolidation, it would be challenging to repay a new loan if you are already struggling to pay off other debts. That’s why if you still have a significant amount of debt left to pay off, we suggest waiting before you apply for a loan. SBA loans are backed by the U.S. Small Business Administration and issued by participating lenders, mostly banks. They are coveted by small business owners because they come with low rates and flexible terms.
• Contact lenders. You need to find a bank or lender that works with the SBA. Most leading commercial banks will offer 7(a) loans, but so do credit unions and other lenders. You can find a list of local SBA lenders by state on the SBA website. “You can contact more than one,” Cruz says. “But this should not be the first time you meet the banker. There are three people that every business person should have a relationship with — an accountant that knows your industry, a lawyer that knows your industry, and a banker that knows your industry.” If you have a relationship with a banker, that’s who you start with, Cruz says. If you don’t know the bankers in your community, try to get around it by having someone you know refer you. Call possible lenders, providing a brief profile of you and your business to see if the lender has an interest in exploring the possibility of a loan. If so, make an appointment to meet the lender(s).

SBA’s 7(a) Loan Guaranty Program serves as SBA’s primary business loan program to help qualified small businesses obtain financing when it is not available elsewhere. Loan proceeds can be used for most business purposes including working capital, equipment, furniture, land and building. Loan maturities are up to 10 years for working capital and up to 25 years for real estate. SBA’s 7(a) Loan Guaranty Program has a maximum loan amount of $5 million, with a maximum exposure of $3.75 million. Thus, if a business receives an SBA guaranteed loan for $2 million, the maximum SBA guaranty to the lender will be $1.5 million or 75%.

My wife had a sba loan when she was younger and before we were married or even met. Her business closed 8 years ago and she owed about 35k on the loan with her mom as a partner as a LLC. The SBA sets maturity terms according to the planned use of the loan proceeds. Most common maturity terms for SBA 7(a) loans are 7-10 years. However, 25 year terms are available for the purchase of commercial for real estate.

The Small Business Act was originally enacted as the “Small Business Act of 1953” in Title II (67 Stat. 232) of Pub.L. 83–163 (ch. 282, 67 Stat. 230, July 30, 1953); The “Reconstruction Finance Corporation Liquidation Act” was Title I, which abolished the Reconstruction Finance Corporation (RFC). The Small Business Act Amendments of 1958 (Pub.L. 85–536, 72 Stat. 384, enacted July 18, 1958) withdrew Title II as part of that act and made it a separate act to be known as the “Small Business Act”. Its function was and is to “aid, counsel, assist and protect, insofar as is possible, the interests of small business concerns”.
The important takeaway is how much more restrictive a CDC / SBA 504 loan is compared to an SBA 7(a) loan. You can not use the proceeds of a 504 loan for working capital, debt refinance, non-owner occupied / investment real estate, etc. You can read more on the SBA’s website.
