Late payment fee: This fee is self- explanatory-it’s charged when a loan payment is made past its due date. A late payment fee may be either a flat fee, frequently around $10 to $35, or a percentage of the payment amount or outstanding balance (often 2% – 5%).

Because the SBA doesn’t always fully collateralize an SBA loan with business assets, it’s not uncommon for them to pursue personal assets in the event of a default. I am not an attorney. I would recommend you seek the advice of one familiar with working with these types of issues. I am unaware of anything that would compel a bank to talk settlement.
You said that “The only requirement that the bank has to get paid by the SBA is that the assets securing the loan be sold. There is no requirement that they sue you, take your house or anything else.” Are you sure they won’t take the house even if it was used as a collateral? I have an SBA loan & used my house as a collateral and now the loan is in default. I have Chapter 7 personal protection but have the lein on my house. I have made an offer in compromise to the lender 5.5 months ago…no and response yet. Will the bank ever act on foreclosing my house? It’s my primary house where I live.

SBA guarantee fee: This is a fee charged by the Small Business Administration for all 7(a) loans it guarantees (the SBA will guarantee loans up to 85% of the loan amount). All SBA lenders are required to pay this fee (if applicable), and lenders have the option of passing this fee onto their borrowers. The guarantee fee is based on the loan’s repayment terms and the dollar amount guaranteed, not the total value of the loan. For loans under $150,000, there is no guarantee fee. For loans over $150,000 with terms of one year or less, the fee is 0.25% of the guaranteed portion. For loans with terms longer than one year, the fee is 3% for loan amounts ranging from $150,000 to $700,000 and 3.5% for loans over $700,000. An additional 0.25% is charged for any guaranteed portion of more than $1 million.
One of the most popular uses of SBA loans is commercial mortgages on buildings occupied or to be occupied by small business. These programs are beneficial to small business because most bank programs frequently require larger down payments and/or have repayment terms requiring borrowers refinance every five years. They can be beneficial to the bank in that banks can reduce risk by taking a first-lien position for a smaller percentage of the project, then arranging for a SBA Certified Development Company to finance the remainder through a second-lien position.
You may qualify for an SBA Military Reservist Economic Injury Loan if an essential employee is called for active military duty and the results in an inability to meet normal operating expenses. If the business is already covered by key man insurance or other business interruption insurance, the amount of the loan will reduce by the amount of coverage.

Our business, an S-corp, secured an SBA loan in 2007. We defaulted in 2012 when our business closed. All assets that were collateral were sold and we got a loan for the remaining equity in our home, also collateral, which went towards the balance. The remainder, apx 50k, has been sent to the SBA or Treasury, not sure if there is a distinction there for collections. Are we personally liable and what can we expect now?
