Hi i got a SBA loan in 2008 and defaulted in 2009 and the company went out of business in 2010. I was told by a attorney that the state statue of limitations had ran out for them to collect from me. Today a really rude lady from SBA told me that government Loans do not have statue of limitations and they could collect till I died then take my estate. I replied I will file bankruptcy before I pay you a dime and hung up. However I really rather not do that and I am wondering was my attorney wrong or was she just being a bully.

Competitive APRs: Big banks can typically make small-business loans with single-digit APRs. Term loans available from online lenders may be available at similarly low rates for the best candidates, but double-digit rates of up to 30% are more common. Cash-flow loans with very quick turnarounds may have higher rates.
Since your new company earns less than $25,000, microloans and personal loans are good options for necessary capital. Microloans through nonprofits and the SBA usually have low APRs and manageable payment terms. If your credit is in the high 600s, you can opt for a personal loan, though they often aren’t available for more than $35,000 and tend to come with higher APRs than microloans.
“Nobody does a good job of providing financing to startup businesses because it’s the highest risk out there,” says Charles Green, founder of the Small Business Finance Institute. “You may have big ideas and plans in place, but you haven’t launched yet.”
The application process for an SBA line of credit through the CAPLines Program is similar to that for an SBA 7(a) loan. Lenders, like banks and credit unions, that participate in the SBA 7(a) program are likely to also participate in the CAPLines program. However, as we mentioned earlier, these lines of credit can be difficult to get as standalone products. Typically you’ll need to bring a lot of other business to a lender to have them find underwriting an SBA line of credit to be worth it.

• Meet with lender(s). You (and your advisors) should dress in a professional manner, as it is important for the lender to get an immediate positive impression, Anderson says. After a brief introduction, you should present the lender with two copies of your business plan, including your financial projections. You should discuss your business including the loan you are requesting (a formal written presentation is not required). The lender will ask questions and you should be prepared to provide detailed information in response. “Make the lender feel comfortable doing business with you,” Anderson says. If the lender is comfortable with the relationship, s/he will provide you with an SBA Loan Package that includes forms required by the SBA and information the lender requires. (SBA loan applications from different lenders are similar, but can vary.) One such form is authorization for the lender to access your personal credit reports — it is generally wise to minimize the number of such authorizations, as each time a lender checks your credit it will impact your FICO Score.
Contrary to what many people think, the SBA itself does not issue loans. Banks, credit unions, community development organizations, microlending institutions, and other partners actually make the loans. For loans, the SBA guarantees part of their repayment. The maximum guarantee is 85 % for loans under $150,000 and 75 % for loans over $150,000.
I had an SBA loan in Florida due to the hurricanes of 2004. In 2007 I lost my job and in six months I was on SSDI knowing that there was no way I would be able to pay the taxes, mortgage or insurance and be able to survive. The Treasury Department started taking money for SBA out of my SSDI. I didn’t mind that it was that every time I would call the SBA to try and get help no one wanted to help. So it took 5 years for the county to take the house for delinquent taxes in 2013. If they had just talked to me to explain anything maybe there might have been something I could have done to keep my home. In my 60’s and having to start over and not in great health. Now I live in a studio which is only 12×20 not that big. I feel like life is over and it will only get worse form here. Enough pity party. I just want the Government to be there for the little people and help like they should, when. They helped with the hurricanes but once that is done so are they. They need to include the taxes in the mortgage so a lot of the tax sales won’t happen. MY home sold for only S30,000 and the buyer sold it for $70,000. Haven’t heard for anyone SBA about the difference. I think it is somewhere around $18,000, Will they just let it slide, seems if they wanted something they would be still deducting from my SSDI? Would I be able to get a Veteran’s loan to get a small home? Any answer would be appreciated. Wish I found this years ago. Maybe something could have been done to keep it. Jude
Meeting a lender’s minimum qualifications and requirements will make you a stronger applicant. Some lenders may offer some flexibility if you’re underperforming in one area but overperforming in another, but your best chance of getting approved is meeting or exceeding all of their minimums.

Hi, I live in California and defaulted on an SBA loan in 2003 when my business closed. I continued making sparatic payments through 2008 and could no longer make payments and had no other contact with SBA until 2013. My final response to SBA was the Statue of Limitations was passed on collecting on the loan, which in California is 4 years. Recently, my Federal tax return. What can be done at this point?

The total number of loans given out in 2016 is overwhelmingly dominated by the general SBA 7a loans. The trend is the same with the total amount of money borrowed by loan type. The microloan program, which focuses on loans of $50K or less, is the one big difference when comparing total number of loans to the total amount of money borrowed. I had a SBA backed loan through Washington Mutual – I couldnt make payments and tried to negotiate a lower payment to payoff as bad debt. They told me I had to default but would never negotiate an affordable payment. So it went to court – now I am paying off the full debt to SBA directly at the amount I could pay per month. I understood my dealings with the bank to be over and my debt moved to SBA. However, I have received a 1099-C from the bank as a cancellation of debt for 1/2 amount still owed and says have to report as income??!!
